Any use of our website and its content for purposes other than personal and noncommercial is prohibited. Contents may be downloaded or electronically copied and printed and displayed for your personal, noncommercial use only. No right, title, or interest in any materials will be transferred to you should you choose to download, copy, or forward any site materials; and is strictly prohibited.

Accuracy of Content
SFspree endeavors to provide the most current and accurate information on its site at all times. However, there may be occasions when some of the information featured on this site may be incomplete, inaccurate or out-of-date. Any errors are wholly unintentional and we apologize if erroneous information is reflected in merchandise price or item availability, or in any way affects your individual order. But please be aware that we present our content 'as is' and make no claims to its accuracy, either expressed or implied. SFSspree reserves the right to correct errors or to update product information at any time without prior notice. In the event that a product is listed at an incorrect price, SFspree shall have the right to refuse or cancel any orders placed for any product listed at an incorrect price. SFspree shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card had been charged for the purchase and your order canceled, SFspree shall issue a credit to your credit card account in the amount charged for the canceled item.
Availability
SFspree works very hard to provide you with unique and inspired products at exclusive prices. As a result, many of these products are only available in limited quantities. We make every attempt to remove from our website any item that is no longer available. If an item is currently on back order, we will make every attempt to include this information with the item on the website. Terms of Sale
By placing an order, you make an offer to us to purchase the vouchers you have selected on the terms and conditions stated in this Agreement. You are required to create an account in order to purchase any product. This is required so we can provide you with easy access to print your orders, view your past purchases, modify your preferences, and to ensure permissible use of the product.
Cash Value
According to the laws of the respective states in which you purchased your SFspree voucher, and in which you wish to redeem your SFspree voucher at the Merchant, the Merchant is responsible for allowing you to redeem your SFspree voucher for the cash value based on the money you actually paid for your SFspree voucher, for a period of time that may extend beyond the expiration date on the SFspree voucher. While the expiration date on the SFspree voucher dictates the last date that you can use your SFspree voucher at Merchant for the promotional offer which is stated on the SFspree voucher, state laws (which vary state-by-state, and which are generally made available by each State on the web) may provide that the Merchant is responsible for honoring the cash value that you paid for your SFspree voucher for a period of time beyond the expiration date stated on the SFspree voucher. If applicable, this is a statutory provision which applies to the Merchant, and it is the sole responsibility of the Merchant (and in no way the responsibility of SFspree as SFspree is not the Merchant, has no obligations of the Merchant, and is merely selling the promotional voucher on behalf of the Merchant) to comply with such applicable laws and statutes which may govern the Merchant.
Restaurant Vouchers
The following special rules apply to vouchers sold for redemption by “Restaurants,” defined as a merchant who offers food and beverage for sale in its regular business operations, and is making such food and beverages available to purchasers of SFspree vouchers. Restaurant vouchers cannot be combined with any other restaurant vouchers, third party vouchers, coupons, or promotions unless otherwise noted in the voucher. Redemption frequency is determined by the restaurant, and shall be stated on the SFspree voucher. At the sole discretion of the restaurant, Restaurant-specific vouchers may be used for alcoholic beverages and Restaurant agrees to comply with all state alcohol laws. Unless permitted by the Restaurant, Restaurant vouchers cannot be used for taxes, tips or prior balances. Restaurant credit may be issued at the sole discretion of the restaurant unless otherwise required by law. Neither SFspree nor the restaurant is responsible for lost or stolen vouchers or restaurant vouchers reference numbers. Unless done so in compliance with the law, reproduction, sale or trade of this Restaurant voucher is prohibited. The SFspree offer (including any related discounts) expires on the date specified on the voucher, except that the Merchant may continue to redeem the unused cash value paid for the voucher (as defined above) to the extent required by applicable law. No cash back beyond cash value upon redemption or at any other time.
Merchant Vouchers
Unless otherwise specified by merchant, voucher cannot be combined with any other gift vouchers, third party vouchers, coupons, or promotions. Merchant voucher may be applied only to merchandise or services sold by merchant, and may not be applied to shipping or handling charges. Unless otherwise specified by merchant, limit one (1) voucher per redemption. Credit may be issued at the sole discretion of the merchant unless otherwise required by law. Neither SFspree nor the merchant is responsible for lost or stolen voucher or voucher's reference number. Unless done so in compliance with the law, reproduction, sale or trade of this voucher is prohibited. The SFspree offer (including any related discounts) expires on the date specified on the voucher, except that the Merchant may continue to redeem the unused cash amount you paid for the voucher (as defined above) to the extent required by applicable law.
Additional Terms and Conditions for All SFspree Vouchers
All Vouchers shall be subject to the terms and conditions of SFspree and the participating Restaurant or Merchant. The Merchant or Restaurant are the sellers of the goods or services which you are purchasing. The holder and issuer of a Restaurant-Specific Voucher is the Restaurant. The holder and issuer of a Merchant Voucher is the Merchant. As a holder and issuer of the Voucher, the Restaurant or Merchant shall be fully responsible for any and all injuries, illnesses, damages, claims, liabilities and costs suffered by or in respect of a customer, caused in whole or in part by the Restaurant or the Merchant, as well as for any unclaimed property liability arising from unredeemed Vouchers or portions thereof. You waive, and release SFspree and its officers, directors, employees and agents from, any claim, liabilities, damages, or injury arising from or related to any act or omission of Merchant or Restaurant in connection with a Voucher or the services/goods provided in connection therewith and/or as it relates to compliance with applicable unclaimed property and other laws relating to the redemption of the Vouchers or any portion thereof. Restaurant-Specific Vouchers and Merchant Vouchers are redeemable in their entirety and on a one time basis only and may not be redeemed incrementally.
Colors
SFspree will make every effort to display, as accurately as possible, the true color of our products on our website. The colors you see associated with any item on our site will depend on your computer monitor, and we cannot guarantee that your monitor's display of any color will be accurate.
Indemnification
You agree to indemnify, defend, and hold harmless SFspree, its officers, directors, employees, agents, affiliates, licensors and suppliers from and against all losses, expenses, damages and costs, including reasonable attorney’s fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.
Venue and Arbitration
SFspree’s headquarters are in Sausalito, California. Legal issues arising out of, but not exclusive to the use of, this site are governed by and in accordance with the laws of the State of California. By using this site, you agree that any dispute or claim arising out of or in connection with this agreement or the performance, breach or termination thereof, or the site, shall be finally settled by arbitration in Marin County, California under the rules of arbitration of the American Arbitration Association.
